TERMS AND CONDITIONS OF SALE

ByLucop®


1. GENERAL

1.1 We are ByLucop®, operated by G.A. Sánchez Rasadore, with NIF 56200703L, residing at 03004, Alicante, Spain. Contact email: contacto@bylucop.com (“ByLucop®”, “we”, “us”, or “our”).

1.2 By purchasing any product through our website www.bylucop.com (the “Website”), you accept these terms and conditions of sale (the “Conditions of Sale”), unless otherwise agreed in writing between you and us.

1.3 Please read these Conditions of Sale carefully before placing any order. You must accept them and have read our Privacy Policy before finalizing your purchase. You can consult the current version at any time on this same page.

1.4 If you are acting on behalf of a legal entity or other business form, these Conditions of Sale do not apply in their entirety. Please refer to Section 10 for the specific conditions applicable to business customers.


2. PRICES AND PAYMENT

2.1 Prices on the Website are shown in euros (EUR). Unless expressly stated otherwise, all prices include applicable VAT. We reserve the right to modify prices without prior notice.

2.2 If a shipping cost applies to your order, it will be added during the checkout process before you confirm the order.

2.3 You can pay by credit or debit card (via Shopify Payments), PayPal, or Klarna. All payment information is transmitted in encrypted form using the SSL protocol and is processed entirely by Shopify Payments under PCI DSS security standards. ByLucop® does not store or have access to the full details of its customers' payment cards.

2.4 Unless expressly stated otherwise, all prices include applicable taxes and customs duties for shipments within the European Union.


3. ORDERS

3.1 By placing an order, you confirm that you are of legal age according to the legislation of your country of residence.

3.2 By placing an order, you confirm that you have read and accepted these Conditions of Sale and that you have read and understood the Privacy Policy. Orders are binding for us only when we have confirmed them in writing by sending an order confirmation to the email address you have provided.

3.3 We reserve the right to cancel orders due to special circumstances, such as technical errors or incidents in the production process. We also reserve the right to modify the price of a product after the order has been placed but before its delivery, upon written notice. In such a case, you will have the right to cancel your order.

3.4 If you place an order as an individual, you acknowledge that the products are primarily intended for personal and non-commercial use. For commercial use, the provisions of Section 1.4 shall apply.


4. PRODUCTION AND DELIVERY

4.1 All our products are made to order (“print on demand”). Once your order is confirmed, the preparation and production time is a minimum of 2 business days and a maximum of 10 business days, to which shipping time is subsequently added according to the chosen method and destination. The times indicated on the Website are estimates and may be subject to change.

4.2 In the event of a significant delay, you may be informed by email. If the delay is materially relevant to you, you will have the right to cancel your order. However, we shall not be liable for delays beyond our control or derived from causes of force majeure, such as armed conflicts, natural disasters, fires, or other serious interruptions.

4.3 Products will be considered delivered at the moment you physically receive them. Products damaged during transport must be reported as soon as possible by sending an email to contacto@bylucop.com.

4.4 If you do not collect your order at the delivery point within the period notified by the shipping company, the following will apply:
• If you exercise your right of withdrawal within the 14-day period: we will proceed to refund the products, deducting the return shipping costs, as indicated in Section 5.
• If you do not collect the order without communicating your withdrawal within the 14-day period: you will be in breach of your obligation to receive. In this case, we will have the right to invoice you for the return shipping costs plus a management fee of 15 EUR, previously informed in these conditions.

5. RETURNS AND RIGHT OF WITHDRAWAL

5.1 You have the right to withdraw from your purchase within 14 calendar days without the need to state a reason. The withdrawal period will expire 14 days from the day on which you, or a third party other than the carrier and designated by you, acquire physical possession of the goods.

5.2 To exercise your right of withdrawal, you must notify us by means of an unequivocal statement by email. Send your request to contacto@bylucop.com indicating your name, order number, and your clear decision to withdraw from the contract. If you wish, you may use the following model withdrawal form, although it is not mandatory:

5.3 To meet the withdrawal deadline, it is sufficient for you to send your communication before the withdrawal period has expired.

5.4 In the event of withdrawal, we will refund all payments received from you, including the costs of standard delivery (with the exception of additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and, in any case, within a maximum of 14 days from the day we receive the returned product or you have provided proof of its shipment, whichever occurs first. The cost of the return shipping label provided by ByLucop® will be deducted from the amount to be refunded, as indicated in Section 5.5. The refund will be carried out using the same payment method used in the original transaction, unless expressly agreed otherwise.

5.5 The direct costs of return (return shipping) in case of withdrawal are borne by the buyer. To facilitate the process, ByLucop® will always provide a prepaid shipping label along with return instructions once the request is confirmed. The cost of said label will be deducted from the total amount to be refunded. Returns must be sent, upon confirmation by us, to: ByLucop® — G.A. Sánchez Rasadore, 03004, Alicante, Spain.

5.6 You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

5.7 Returns for manufacturing defects, damage during transport, or functional failure: once ByLucop® has received and inspected the product and recognized the defect or failure, the return and re-shipping or replacement costs will be fully borne by ByLucop®. In all cases, ByLucop® will provide a prepaid shipping label along with instructions to proceed with the return; in these cases, the shipping cost will not be deducted from the refund nor passed on to the buyer. See Section 6 for more details.


6. WARRANTY

6.1 If you reside in the EU/EEA, you have the right to a legal guarantee of conformity for a period of 3 years from the date of receipt of the goods, in accordance with Directive (EU) 2019/771, on which Royal Legislative Decree 1/2007 (RDLCU) is based. You must notify us of the defect within a reasonable time from when you became aware of it or should have become aware of it. The legal guarantee does not apply in case of defects caused by improper use, ordinary wear and tear, or accidents.

6.2 To exercise your warranty right, contact us at contacto@bylucop.com. We will examine all products and determine if the defect is covered. If so, at our choice: (i) we will repair the product; (ii) we will replace it partially or totally; or (iii) we will refund the price. If you choose to return the product and we conclude that the defect is not covered by the warranty, we reserve the right to invoice you a management fee of 20 EUR plus the costs of re-sending the product.


7. LIMITATION OF LIABILITY

7.1 Except in cases of willful misconduct or gross negligence, our liability to you shall be limited to direct damages and an amount equivalent to the price paid for the goods subject to the claim. We shall not be liable for indirect losses, losses in your business activity, nor for losses that we were unable to foresee at the time of entering into the contract with you, nor that we could reasonably have avoided or overcome.

7.2 We do not guarantee that the images published on our Website exactly reflect the actual appearance of our products, as colors and textures may be affected by the type, quality, and resolution of your screen. We always strive to faithfully represent our products.


8. DISPUTE RESOLUTION

8.1 We will always try to resolve any dispute by mutual agreement. Contact us at contacto@bylucop.com.

8.2 If you are not satisfied with our response or do not wish to address us directly, you may resort to the alternative dispute resolution mechanisms available to consumers in the EU, through the European Commission's Online Dispute Resolution (ODR) platform, available at: https://ec.europa.eu/consumers/odr

8.3 If you reside in Spain, you can also go to the Consumer Arbitration System, managed by the Spanish Agency for Consumer Affairs, Food Safety and Nutrition (AECOSAN / AESAN), or to the Consumer Arbitration Board of your autonomous community or municipality. This system offers dispute resolution free of charge for consumers.

8.4 These Conditions of Sale are governed by Spanish law. Any dispute that cannot be resolved amicably will be submitted to the competent courts of Alicante, Spain, without prejudice to the provisions of Section 9.5 for consumers residing in the EU.

8.5 Notwithstanding the provisions of Section 9.4, these Conditions of Sale will not limit any consumer protection rights you may have under the mandatory legislation of your country of residence. If you are a consumer and habitually reside in the EU or EEA, you may initiate legal action before the competent courts of your place of residence.

9. BUSINESS CUSTOMERS (B2B)

9.1 If you are acting on behalf of a legal entity or other business form, and we have not entered into a specific contract that replaces these Conditions of Sale, these Conditions of Sale shall apply together with Incoterms® 2020 regarding the purchase and sale of our products, with the following modifications and additions.

9.2 Sections 2.4, 3.4, 4.3, 5, 6.1, 7.1, 9.2, 9.3 and 9.5 shall not apply.

9.3 If you have placed an order outside the Website, and unless otherwise agreed, the payment method will be by invoice due 30 days from the invoice date. We reserve the right to apply late payment interest in accordance with Law 3/2004, of December 29, which establishes measures to combat late payment in commercial operations. We reserve all other legal rights and remedies.

9.4 You are obliged to inspect the products at the time of receipt and to verify that the packaging is intact and that the goods do not present damage or malfunctions. You must notify us of any defect within a reasonable time from when you became aware of it or should have become aware of it.

9.5 Except in cases of willful misconduct or gross negligence, our liability to you shall be limited to direct damages and an amount equivalent to half the price paid for the goods subject to the claim. We shall not be liable for indirect or consequential damages.

9.6 In the event of conflict between these Conditions of Sale and Incoterms® 2020, these Conditions of Sale shall prevail.


10. ARCHIVE SALE

10.1 Scope ByLucop® Archive Sale includes a limited selection of products with minor aesthetic deviations or cosmetic imperfections. All products are fully functional, and the imperfections do not affect safety or performance.

10.2 Information on known imperfections Customers are informed before purchase that Archive Sale items have known cosmetic imperfections, such as minor surface irregularities, slight asymmetry, or texture variations. Such imperfections are clearly disclosed and form the basis for the reduced price.

10.3 Prices and discount Archive Sale products are sold at a discount of 30 to 50%, reflecting the aesthetic deviations of each item.

10.4 Warranty and limitations on claims In accordance with Spanish and European consumer regulations: customers may not make claims for cosmetic imperfections known and reported before purchase. Customers retain the right to claim for functional defects or hidden defects not related to the disclosed imperfections.

10.5 Right of withdrawal For online purchases, customers have a 14-day withdrawal period, in accordance with European consumer regulations. Returns require the product to be returned in substantially the same condition as received. The right of withdrawal does not apply to disclosed cosmetic imperfections, as these do not constitute grounds for claim or refund.

10.6 Limited availability Archive Sale items are available in limited quantities and are sold on a strict order of purchase. We reserve the right to run out of stock before the announced end date.

10.7 Warranty in Archive Sale The warranty covers functional defects not related to the disclosed imperfections. Cosmetic deviations reported before purchase are not covered.

10.8 Final nature regarding disclosed imperfections For disclosed cosmetic imperfections, Archive Sale purchases are considered final, without price adjustment or compensation for said known characteristics. This does not affect the customer's statutory right to a 14-day return for online purchases.


11. GENERAL PROVISIONS

11.1 We will process your personal data in accordance with our Privacy Policy and our Cookies Policy, both available on the Website. By purchasing products through us, you confirm that you have read and understood these policies.

11.2 We, or our licensors, are the owners of all content published on the Website. Such content is protected by copyright, trademarks, and/or other intellectual and industrial property rights.

11.3 We reserve the right to modify these Conditions of Sale at any time without your prior consent. However, no modification will affect orders placed prior to said modification.
